If they're not convicted as of yet how can the defendant be held indefinitely and stripped of the right to refuse treatment?
Dr. Lisa
The same reason that they can be stripped of their freedom to leave jail/prison among other things, I suspect. Here's where I must paraphrase the great Dr. Leonard McCoy: "Dammit, Tim, I'm a doctor, not a lawyer!" You may want to ask a criminal lawyer or psychologist/psychiatrist this. It takes the opinion of multiple psychologists to have someone found not competent, and it's usually only for quite severe (and obvious) disorders.
